Who pays the title and escrow fees — buyer or seller?

The amounts are set — the premium and our closing fees are filed rates — but who pays which charge is negotiable, and the contract decides it. Common Central Colorado custom is the seller providing the owner's policy and the buyer paying the lender's policy, with the escrow fee often split between the parties. Your contract always wins.
